Wall collapses in transit base underpass

Monday, October 12, 2015

According to an article on KOMO.com, a concrete wall in the underpass for the Metro Transit Center at 165th and I-5 collapsed in Saturday's rainstorm.

Travis Phelps, with the Washington State Department of Transportation, said the wall has had water buildup behind it over time and caused the wood underneath the concrete to weaken. The massive amounts of rain that fell on Saturday only added to the pressure behind the wall, which made it collapse, according to Phelps.

The north and sound HOV lanes in that area will be closed until repairs are complete.

Charges may be filed in dog bite case

Friday, September 4, 2015

My Edmonds News has been following the story of the Shoreline boy who was bitten by a dog in a "No Dogs" area of Brackett's Landing on the Edmonds waterfront.

The owner of the dog left the scene but the mother was photographing her son and got photos of the dog and owner, which led to his identification.

At first, it appeared that there would be no consequences for the dog and its owner, other than a "dangerous dog warning."

But according to the story by Larry Vogel in My Edmonds News, felony charges may be filed.

"After reviewing the facts in the case, Edmonds police have prepared a report to the Snohomish County Prosecutor that could lead to class C felony charges being brought against the owner of a dog who bit a 6-year-old boy at Brackett’s Landing Aug. 19.
"News coverage of the incident by My Edmonds News and others led to a tip that helped police identify the owner, a 40-year-old Edmonds man.
"'We’ve been studying the facts in the case, and have determined that these might justify felony charges under RCW 16.08,” Sgt. Shane Hawley told My Edmonds News Friday.
"The report was sent to the prosecutor late in the day Friday. The prosecutor will review the report next week, and based on this review will decide whether charges are justified, Hawley said."

Owner of dog who bit Shoreline boy has been located

Wednesday, September 2, 2015

Thanks to a tip from a citizen, Edmonds police have identified the owner of the dog who attacked a 6-year-old Shoreline boy in the “no dogs” area of Brackett’s Landing Park in Edmonds on Aug. 19. The owner did not identify himself and left the scene with the dog immediately after the incident.

Fortunately the boy’s mother was taking video on her cell phone at the time of the attack. Edmonds Police circulated screen shots from the video to My Edmonds News and others (See previous article) in an attempt to locate the dog and its owner.

“The child was taken to Swedish/Edmonds for treatment of puncture wounds around his mouth, chin and arm,” said Edmonds Police spokesperson Sgt. Shane Hawley. “He was taken home from the ER with no hospital stay, and is doing well.”
“We received several tips from the public.  One of them panned out and led us to the suspect,” Hawley said.

According to Hawley, the owner is a 40-year-old man from Edmonds, and the dog, a female pit bull mix, is unlicensed. The incident occurred in the beach area north of the restrooms and below Sunset Avenue, which is posted “no dogs.” The owner has been charged with two animal control violations: 1) having a dog in a no dogs allowed area, and 2) no animal license.

Hawley explained that no criminal charges can be brought against the owner because a dog bite is not considered an assault under state law. This also means there is no criminal violation for leaving the scene of the incident.

However, Edmonds City Code calls for animals involved in bite incidents to be quarantined for 10 days, with the quarantine period starting at the time of the bite. Quarantine does not necessarily have to be at a kennel.  The dog can be placed on quarantine at the owners home. But in this case, by the time the dog and owner were found, the 10-day period was already over.

“We checked with the animal’s vet and the dog was current on shots and in good health, posing no health risk to the boy,” Hawley said.   “We also served the owner with a potentially dangerous dog declaration.”

Dangerous dog declarations are part of the Edmonds Quarantine Statute (EMC5.05.040), and require that the pet owner take extra measures including the purchase of extended liability coverage and building enhanced enclosures.

SEC announces asset freeze against Potala Place Shoreline developer

Tuesday, August 25, 2015

The developer of Potala Place Shoreline in Aurora Square is under investigation by the Securities and Exchange Commission, charged with fraud. See previous story.

Washington D.C., Aug. 25, 2015 — The Securities and Exchange Commission today announced an asset freeze obtained against a man in Bellevue, Wash., accused of defrauding Chinese investors seeking U.S. residency through the EB-5 Immigrant Investor Pilot Program by investing in his companies.

The SEC alleges that Lobsang Dargey and his “Path America” companies have raised at least $125 million for two real estate projects: a skyscraper in downtown Seattle and a mixed-use commercial and residential development containing a farmers’ market in Everett, Wash.  But Dargey diverted $14 million for unrelated real estate projects and $3 million for personal use including the purchase of his $2.5 million home and cash withdrawals at casinos.

“We allege that Dargey promised investors their money would be used to develop specific real estate projects approved under the EB-5 program, but he misused millions of dollars to enrich himself and jeopardized investors’ prospects for U.S. residency,” said Jina L. Choi, Director of the SEC’s San Francisco Regional Office.

According to the SEC’s complaint filed yesterday in U.S. District Court for the Western District of Washington:
  • Under the EB-5 program, foreign citizens may qualify for U.S. residency if they make a qualified investment of at least $500,000 in a specified project that creates or preserves at least 10 jobs for U.S. workers.
  • Dargey and his companies obtained investments from 250 Chinese investors under the auspices of the EB-5 program.  Path America SnoCo and Path America KingCo operated as regional centers through which EB-5 investments could be made.
  • Dargey told U.S. Citizenship and Immigration Services (USCIS) and EB-5 investors that he would use investor money only for the Seattle skyscraper and Everett, Wash., projects.
  • Dargey and his companies misled investors about their ability to obtain permanent residency by investing in the Path America projects.  For example, Dargey knew that USCIS can deny investors’ residency applications if investor money is used for a project that materially departs from the approved business plan presented to USCIS.  Dargey failed to tell investors that he and his companies had departed from the business plan by using investor money for personal expenses and unrelated projects.

Late yesterday, the court granted the SEC’s request for an asset freeze and issued an order restraining Dargey and his companies from soliciting additional investors.  The SEC also was granted an order expediting discovery, prohibiting the destruction of documents, and requiring Dargey to repatriate funds he transferred to overseas bank accounts.

The SEC’s investigation was conducted by Brent Smyth and Michael Foley of the San Francisco office and supervised by Steven Buchholz.  The SEC’s litigation will be led by Mr. Smyth and Susan LaMarca.  The SEC appreciates the assistance of the USCIS.

Assets from the alleged fraud project were frozen by Judge James L. Robart. Dargey is scheduled for a preliminary hearing for the three fraud claims on Sept. 14 in the U.S. District Court in Seattle.

Edmonds police rescue suicidal Shoreline woman

Edmonds police and Snohomish County Fire District 1 crews were called to the Edmonds waterfront early Tuesday morning after receiving a report that a 37-year-old Shoreline woman had threatened to swim out into Puget Sound and kill herself. Police were able to convince the woman to come back to shore, and she is now being evaluated at Swedish Edmonds hospital, police spokesman Sgt. Josh McClure said.

According to McClure, a person making deliveries on Main Street around 4:30 a.m. Tuesday called 9-1-1 to report “a distraught female threatening to get in the water and commit suicide.” Police and Fire District 1 crews were dispatched to the waterfront, and police used night vision equipment to spot the woman “actively swimming” about 100 yards from shore, on the north side of Brackett’s Landing, McClure said.

At least two officers waded out into the water “up to their knees” and were able to coax the woman back to a waiting Fire District 1 ambulance, he added.

Ferry traffic experienced a slight delay as a result of the incident, which was resolved by 5:27am, McClure said.

Reunion Island - where wreckage from missing plane was found

Wednesday, August 5, 2015

Reunion Island is east of Africa and Madagascar
Australia is far to the east
Google Earth map

National and local news have broken the story that the airplane part found on Reunion Island was, indeed, from the long-missing Malaysian flight 370 (see story in The Seattle Times).

Shoreline photographer Marc Weinberg was on Reunion in 2012.

It is a remote island and most people have never heard of it. We traveled there in February 2012.  It is a beautiful and well maintained island since France has been willing to provide significant funding for infrastructure, unlike other island that sought their independence and are without money to keep things running well.

One beautiful place we visited was Nez le Boeuf, where people live in a beautiful valley which was carved out by the molten lava pouring from the volcano.

We drove from the port city of St. Denis into the mountains of Reunion Island. Piton de la Fournaise is said to be the world's most active volcano dating back 500,000 years. 2010 was an especially active year with many eruptions. The largest and longest was on December 9, 2010 and lasted 2 days. If you look at that image closely you can see people walking around the rim of the opening within the caldera. This image was taken from Pas de Bellecombe at 7,582 feet above sea level.

Piper's bagpipes stolen

3/4 sterling silver McCallum bagpipes, with boxwood mounts
stolen from piper Kevin Auld

Kevin Auld is a professional bagpipe player and the leader of the local Northwest Jr. Pipe Band that sends players to national competition in Scotland each year.

Sunday night his bagpipes were stolen from near his home on 25th NE across from Shorecrest. Here's his story.

Kevin Auld
Last night after getting home, exhausted, at 10:30pm from Portland, we unloaded the car and I accidentally left my bagpipes sitting out by the car on the street. It was a black pipe case sitting in the dark, so it was a simple mistake. This morning I couldn't find them in the house and when I checked outside they were gone.
I spoke with a police officer today and will be filing a report. They do the work of forwarding the item description to all of the local pawn shops, which is great.
These pipes weren't a family heirloom or an antique collectible set, but they were important to me and are my livelihood. My workhorse. They are 3/4 sterling silver McCallum bagpipes, with boxwood mounts. Also contained in the pipe case are extra band chanters, practice chanters and supplies. All told it probably is a loss of around $4000.
This could not have come at a worse time, with the band leaving for Scotland in a few weeks and solo gigs between now and then. I do have some pipes around the house that I can play, so I should be fine for a while until I either get my own set back or can save up for some new ones.

Sometimes thieves will steal spontaneously, then when they find out it's something they can't easily sell, they will toss the item in the bushes, so be on the lookout for this local musician's pipes.
