Washington State man arrested on felony and misdemeanor charges for actions during Jan. 6 Capitol Breach

Thursday, August 22, 2024

WASHINGTON — A Washington State man was arrested on felony and misdemeanor charges related to his alleged conduct during the Jan. 6, 2021, breach of the U.S. Capitol. His alleged actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the 2020 presidential election.

Thomas Hobbs of
Snohomish WA
Thomas Hodo, 47, of Snohomish, Washington
, is charged in a criminal complaint filed in the District of Columbia with felony civil disorder and misdemeanor offenses of entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, and disorderly conduct in a capitol building or grounds.

The FBI arrested Hodo on Aug. 20, 2024, in Phoenix, Arizona, and he made his initial appearance in the District of Arizona.

Codefendant Derek Noftsger was previously charged for his role in the events of January 6, 2021. (see previous story)

According to court documents, Noftsger and Hodo were identified in open-source video standing near a line of police officers on Jan. 6, 2021, on the West Plaza of the U.S. Capitol grounds.

At approximately 1:37pm, Hodo allegedly joined with a group of rioters who attempted to pull a bike rack barricade away from police as Noftsger stood nearby and watched. About one minute later, Hodo walked over to Noftsger and appeared to place a flag in Noftsger's backpack. Hodo then appeared to take an item from Noftsger's bag and threw the item in the direction of the police line.

About six minutes after throwing an item in the direction of officers, Hodo approached the police line and began to speak using a megaphone.

In part, Hodo stated, "it is our constitutional duty, we have to stand up to a tyrannical government, we are not supposed to secede to a tyrannical government," then went on to claim that he supported the police, before proclaiming that "every treasonous traitor will be hung . . . . we will take our country back."

After handing off the megaphone to another rioter, he looked at the officers on the police line and said, "you guys are a f— disgrace."

At approximately 2:26pm, multiple rioters began to push against the police line near the two defendants. Officers on the police line pushed the rioters back, and, in response, it is alleged that Noftsger picked up a police officer’s riot shield from the ground and faced a Metropolitan Police Department officer. When officers pushed back a rioter near Noftsger, he allegedly lifted the riot shield above his head with both hands and threw it at the officers.

It is then alleged that Hodo picked up an object off the ground that appeared to be a canister of pepper spray and attempted to spray it at the officers; however, the canister was not deployed. Hodo then allegedly threw the canister in the direction of the police officers.

At about 2:28pm, rioters on the West Plaza overran the police line and Noftsger and Hodo climbed onto the Southwest Scaffolding. The two men then made their way to the Lower West Terrace and unfurled the flag that they had been carrying.

In an open-source video, Hodo can be heard stating, "It could get a lot worse, we came in peace this time, it could get a lot worse, believe me we are well armed if we need to be."

Why is Aurora Avenue crime concentrated in Seattle, not Shoreline?

Wednesday, August 21, 2024

Photos of the newly completed Aurora Corridor 2015

By Diane Hettrick

There's no question that the northern stretch of Aurora in Seattle - from 105th to 145th - is the wild west. Drive by shootings, pot shop invasions, pedestrians on the sidewalk hit by cars, drug deals. There is prostitution but the crime seems to center on gun battles between pimps.

The Seattle City Council is considering tackling the problem by declaring it a 'no prostitution' zone. And they can't help but notice that all those problems stop at the city border and are non-existent in Shoreline.

This article by Amy Radil in KUOW.org discusses this and interviews Shoreline Police Chief Kelly Park, Capt. Tim Meyer, and Jim Hammond, Shoreline's intergovernmental relations manager to find out what Shoreline is doing right.

Shoreline resident indicted for drug and gun crimes

Monday, July 15, 2024

Seattle – A 48-year-old Seattle area man is in federal custody after being indicted by a grand jury for two counts of possession of controlled substances with intent to distribute and possessing a firearm in furtherance of a drug trafficking crime, announced U.S. Attorney Tessa M. Gorman.

Simon Offord is allegedly linked to drug dealing in multiple Seattle neighborhoods and in various homeless encampments.

Searches of his vehicles and a Shoreline hotel room resulted in seizures of significant quantities of fentanyl, cocaine, heroin, methamphetamine, and Alprazolam.

Offord was arraigned on the indictment on July 8, 2024, and detained on July 11, 2024.

According to police reports and other records filed in the case, Offord came to the attention of Seattle Police patrol officers in December 2023 when he drove the wrong way down a street in Seattle. Before police could contact him, he abandoned the car he was driving in a parking lot.

Inside the car officers saw what appeared to be drugs. After getting a warrant to search the vehicle they found drugs packaged to for delivery, scales, and other indications of drug dealing as well as a ‘ghost gun’- one made without a serial number.

Over a number of months, Seattle Police looked for Offord and ultimately tracked him to a Shoreline hotel, just off of Aurora Avenue.
On May 30, 2024, Offord was arrested at one of his dealing locations along Aurora in North Seattle. A search of his hotel room and vehicle yielded nine pounds of fentanyl powder, approximately 2900 fentanyl pills, and more than a pound of methamphetamine, crack cocaine, heroin, and other drugs.
Police also seized another firearm. Offord was booked into the King County Jail but later was released on bail.

Due to the large amount of drugs involved in these seizures, the crimes are punishable by a mandatory minimum ten years in prison and up to life in prison. Possessing a firearm in furtherance of a drug trafficking crime adds an additional five years in prison to run consecutive to any other sentence imposed.

The charges contained in the indictment are only allegations. A person is presumed innocent unless and until he or she is proven guilty beyond a reasonable doubt in a court of law.

The case is being investigated by the Seattle Police Department.

Two Irish nationals stole more than $400,000 from Shoreline homeowner whom they misled about roof and foundation repairs

Sunday, July 14, 2024

The man at your door says you have a hole in your roof - but do you?

Seattle – Two individuals from Ireland are charged in U.S. District Court in Seattle with conspiracy to commit wire fraud for their theft of more than $400,000 from a Shoreline homeowner.

Patrick McDonagh and Matthew McDonagh were arrested by U.S. Customs and Border Protection in mid-June and have been held at the immigration detention center. They have been transferred to the Federal Detention Center at SeaTac and will make their first appearance on the criminal charge today at 2:00 PM.

According to the criminal complaint, the pair was part of a group that traveled the country allegedly scamming homeowners – especially the elderly – by falsely representing the home needed an urgent repair.

One older homeowner in Shoreline lost about $435,000 to the scheme.

“This type of fraud on our elderly neighbors is heartbreaking,” said U.S. Attorney Tessa M. Gorman. “To pose as someone trying to help them, while all the while the goal is to steal as much as they can from the victim’s hard-earned retirement funds. It is a special kind of cruelty to engage in such conduct.”

The men first approached the victim in January 2024, claimed they were working in the neighborhood and had noticed that the victim had a hole in his roof. The men offered to fix the hole and remove the moss from the roof.

Over the course of a few days, they pressured the victim to write them checks for their “services” of $15,000, $20,000, and $26,000. They also claimed that the victim’s foundation was cracked, and they said they would repair that with a “titanium tie rod system.”

The roof had no hole, and the foundation was not failing. However, the men dug trenches and poured some concrete to make it appear work was done, and each day they pressured the victim to write more checks. They even demanded an extra $20,000 for “taxes.”

Ultimately, they demanded the victim wire $200,000 to a third party for building supplies – again far in excess of any work they claimed to have done. In all the brothers stole $435,000 from the victim.

The FBI investigation connected the brothers to contractor fraud complaints in Washington County, Oregon and Spokane, Washington totaling about $50,000. In those cases, they used fake photos of holes in the homeowner’s roof or alleged problems with the house’s foundation or posed as local-reputable businesses.

“Sadly, seniors are often an attractive target for fraudsters attempting to steal a lifetime of savings, and scammers are skilled at deceiving people, said Richard A. Collodi, Special Agent in Charge of the FBI Seattle field office.
“We encourage consumers to stay vigilant and avoid making quick decisions before doing research or getting to know someone. If you think you or someone you know could be a fraud victim, call your financial institution immediately and report suspected fraud to the FBI at tips.fbi.gov.”

Red flags for contractor fraud:
  • The contractor knocks on your door looking for business because they are “in the area” and uses aggressive sales tactics.
  • The contractor pressures you for an immediate hiring decision.
  • The contractor accepts only cash as payment and demands full payment before starting any work.
  • In the sales pitch, the contractor claims to have materials left over from a previous job.
Tips to avoid contractor fraud:
  • Always get multiple estimates for any work you want done.
  • Ensure contractors are licensed and insured. Look them up at Washington State’s Department of Labor & Industries website
  • Check with consumer protection agencies such as the Better Business Bureau and Federal Trade Commission to search for complaints against a contractor.
Conspiracy to commit Wire fraud is punishable by up to 20 years in prison.

Lynnwood man sentenced for assaulting law enforcement and other charges during Jan. 6 Capitol Breach

Friday, May 24, 2024

A Washington state man was sentenced to prison today after pleading guilty to two felony charges related to his conduct during the breach of the U.S. Capitol on Jan. 6, 2021. His actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the 2020 presidential election.

Tucker Weston, 35, of Lynnwood, Washington
, was sentenced to 24 months in prison, 36 months of supervised release, and ordered to pay $2,000 in restitution by U.S. District Judge Reggie B. Walton. Weston previously pleaded guilty to two felony charges of civil disorder and assaulting, resisting, or impeding certain officers on July 31, 2023.

According to court documents, Weston traveled from Seattle to Washington, D.C., to attend the “Stop the Steal” rally at the Ellipse and protest the results of the 2020 presidential election.

On the morning of Jan. 6, 2021, Weston attended the rally and, afterward, marched with other protestors toward the U.S. Capitol. Near the Capitol, Weston participated in removing a metal barricade on the Capitol grounds, enabling rioters to advance closer to the building.

A few moments later, Weston shoved officers who were trying to prevent the rioters from progressing any closer to the Capitol building. As Weston shoved an officer, other USCP officers sprayed the crowd with oleoresin capsicum (OC) spray. Around 1:13 p.m., Weston moved to the south side of the West Plaza as MPD officers arrived on the scene to assist USCP in guarding the Capitol building. Upon arrival, MPD used bike racks to reestablish the police line and to create a barrier between the Capitol building and the rioters. Weston approached this police line as another rioter began yelling at the police. That rioter assaulted an MPD officer, and Weston shoved other officers attempting to subdue that rioter.

Tucker Weston, of Lynnwood, sentenced
for assaults during January 6 Insurrection
After assaulting the officer, Weston adopted an aggressive stance with his fist clenched toward the police, protecting their line from the rioters. Weston was sprayed with OC spray but did not heed commands to back away from the line.

Later, Weston made his way to the north side of the Plaza. Once there, Weston joined with a group of rioters in using a bike rack to push against law enforcement.

During his two hours on the West Plaza, one of the most violent areas of the Capitol on January 6th, Weston witnessed other rioters push, punch, and use pepper spray against officers.

At multiple points, Weston yelled at law enforcement to “Come on” and “F— you.” For two hours, Weston yelled and screamed as part of the large and violent mob.

Weston then left this area, moved up the northwest stairs to the Upper West Terrace, and entered the Capitol building through a broken window next to the Senate Wing Door. He remained in the building only briefly before exiting back through the Senate Wing Door and making his way to the North Portico.

Court documents say that law enforcement officers removed Weston and others from the North Portico, and Weston then left the area and traveled to the northeast corner of the Capitol grounds, where he found a group of rioters vandalizing media equipment.

Weston and other rioters then kicked and smashed the equipment. After kicking the equipment, Weston received a bag of stolen media equipment from another rioter and walked away.

The FBI arrested Weston on Oct. 19, 2022, in Lynnwood.

The U.S. Attorney's Office for the District of Columbia and the Department of Justice National Security Division's Counterterrorism Section prosecuted this case. The U.S. Attorney's Offices for the Western District of Washington provided valuable assistance.

This case was investigated by the FBI’s Seattle and Washington Field Offices, which identified Weston as BOLO AFO (Be on the Lookout Assault on Federal Officer) #437 on its seeking information photos. Valuable assistance was provided by the U.S. Capitol Police and the Metropolitan Police Department.

In the 40 months since Jan. 6, 2021, more than 1,424 individuals have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including more than 500 individuals charged with assaulting or impeding law enforcement, a felony. The investigation remains ongoing.

AG announces investigation into Catholic Church’s handling of child sex abuse allegations

Friday, May 10, 2024

Attorney General Bob Ferguson with staff and survivors of sexual abuse by Catholic clergy

The State Attorney General is taking legal action against the Seattle Archdiocese, as part of the investigation into whether the three Washington dioceses of the Catholic Church used charitable funds to cover up allegations of child sex abuse by clergy.

The Attorney General’s Office sent subpoenas to the Seattle Archdiocese, the Diocese of Spokane and the Diocese of Yakima.

The Seattle Archdiocese refused to cooperate. Consequently, Ferguson filed a petition to enforce the subpoena in King County Superior Court. The office is asking the court to hear the petition on May 22.

The Attorney General’s Office has a longstanding policy that it does not comment on investigations, including confirming whether they exist. Because the Seattle Archdiocese refused to comply with the office’s subpoena, the office now must seek a court order to move the investigation forward. This process made the investigation public.

“Washingtonians deserve a public accounting of how the Catholic Church handles allegations of child sex abuse, and whether charitable dollars were used to cover it up,” Ferguson said.
“As a Catholic, I am disappointed the Church refuses to cooperate with our investigation. Our goal is to use every tool we have to reveal the truth, and give a voice to survivors. If you or a loved one have been impacted by clergy abuse, please contact my office.”

After he gets out of prison, Nelson will be on supervised release for life, with special conditions that include a prohibition against any contact with minors without permission.

Nelson hid two cameras in bathrooms at the S Bar F Scout Ranch in St. Francois County in July of 2021 while working there as a volunteer. Nelson hid the cameras in paper towel dispensers, positioning them so they would capture a shower stall and other portions of the bathroom.

One camera was discovered when a scout leader and scouts were cleaning out one of the restroom stalls. A search uncovered another camera, and leaders then called the St. Francois County Sheriff’s Department.

When questioned later by a sheriff’s deputy after being spotted near the bathrooms, Nelson lied and said he was looking for a cell phone charger that he’d left in the stall.

During Thursday’s hearing, victims and their parents said Nelson was supposed to be protecting the scouts and was supposed to be someone children could trust. Nelson’s crimes, they said, have now left them unable to trust others. The victims also said they now experience fear and discomfort every time they try to use a public bathroom.

Nelson, 41, of Redmond, Washington, pleaded guilty in January to two counts of production of child pornography and two counts of attempted production of child pornography.

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice.

Led by U.S. Attorneys’ Offices and the Department of Justice Criminal Division's Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.
